Construction Case:

We have represented the Contractor in a construction case related to a multi-purpose project in UAE amounting to AED 2.5 Billion. The claim has been initiated due to Employer’s abuse termination of the Contract and the latter’s failure in paying the Contractor the amounts due under six certified certificates. A summary court order has been obtained to stay the liquidation of the bank guarantees then succeeding in obtaining a favorable judgment confirming the Employer’s breaches and his liability to pay:

(a) the value of the work done as certified by the Engineer, in addition to the interest upon all sums from the date on which became due in accordance with articles 60.10 and 69 of the Fidic.

(b) loss of profit which represents 8% of the remaining works value.

(c) compensation against labors and mobilization.

(d) returning the original bank guarantees.

(e) compensation against the insurance premiums for the remaining period after the termination.

(f) Releasing the retentions.
