Arbitration Case:
We have succeeded in nullifying an Arbitration Award related to a rental issue of a well-known Wellness SPA, which was issued against our client’s favor through ADCCAC. The main reason for nullifying the Award was the lack of capacity (Locus standi) of the person who signed the Lease Contract on behalf of the General Manager of the Company, as we were able to prove that agreement on Arbitration Clause has not been concluded by an authorized person with full capacity and authority to act on behalf the Company, as the Court of Cassation has embraced our defense, repealed the Appeal Judgment and declared the Arbitration Award as null and void.
